General Terms and Conditions

1. Conclusion of the Contract

By registering, the Customer offers the Organizer the binding conclusion of a travel contract.
Registration may be made in writing or by e-mail. The travel contract only becomes effective upon our written booking confirmation and the deposit mentioned below.

2. Services and Service Description

2.1 Scope
The scope of the contractual services is determined by the service description in our offer and the booking confirmation

2.2 Hunting-Specific Information
Hunting trips take place in the wild. We expressly point out the following:Hunting success (quantity of game, trophy quality) cannot be guaranteed, as it depends on external factors (weather, wildlife behavior) as well as the personal passion and shooting skills of the Guest.We reserve the right to make reasonable changes to the itinerary or hunting grounds due to weather conditions.Non-hunting companions accept that hunting requirements take precedence and that accompanying the hunter into the field is only possible by prior arrangement and depending on local conditions.

3. Payment Terms

The travel price is to be paid as follows:

Deposit:
A deposit of 30% of the total price is due within 10 days after receipt of the booking confirmation.
Final Payment:
The remaining 70% of the price, as well as any additional harvest fees or incidental costs, must be settled on-site on the last day of the trip.Without timely payment of the deposit, there is no entitlement to the execution of the trip.

4. Cancellation by the Customer

You may withdraw from the trip at any time prior to the start of the journey. The cancellation must be made in writing (e-mail is sufficient). The date on which the notification is received by us shall be decisive. In the event of cancellation, we will charge the following standardized cancellation fees:

• Up to 120 days before arrival: 30% of the agreed total price.
• 119 to 61 days before arrival:
• 50% of the total price.
• 60 to 31 days before arrival:
• 75% of the total price.
• From 30 days before arrival, in the event of a no-show, late arrival, or early termination of the trip: 100% of the total price.

The Customer reserves the right to prove that the Organizer has incurred no damage or significantly less damage than the specified fee.

5. Withdrawal and Cancellation by the Organizer

We may withdraw from the contract if the execution of the trip is significantly hindered or endangered by unforeseeable extraordinary circumstances (force majeure, such as war, epidemics, natural disasters, or government orders). In such cases, payments already made will be refunded; further claims are excluded.

6. Travel Insurance

The travel price does not include trip cancellation or trip interruption insurance. We are unable to provide insurance for customers. However, we strongly recommend that you independently obtain appropriate travel insurance as well as international hunting liability insurance to protect yourself against financial risks in the event of cancellation or accidents.

7. Indemnity, Waiver and Assumption of Risk Agreement

The following indemnity, waiver and assumption of risk agreement is accepted upon conclusion of the contract:

7.1 Acknowledgement and Assumption of Risk
I expressly acknowledge that my presence on a private wildlife and hunting farm involves inherent dangers, including but not limited to: dangerous wild animals, hunting activities, use of firearms, off-road driving, remote and uneven terrain, weather conditions, and limited access to medical care.I voluntarily assume all such risks in full.

7.2 Voluntary Participation
My participation in all activities and my presence on the property are voluntary and entirely at my own risk.

7.3 Waiver and Release of Liability
To the fullest extent permitted by law, I hereby irrevocably waive and release Sandy Creek Safaris Ltd. (Pty) Ltd., its directors, shareholders, employees, agents, contractors, and subcontractors (“the Indemnified Parties”) from any and all claims arising from injury, death, loss, or damage, whether caused by negligence or otherwise.

7.4 Indemnity
I agree to indemnify, defend, and hold harmless the Indemnified Parties from and against any and all claims, damages, losses, liabilities, or expenses (including legal costs) arising from my conduct, participation, or presence, including third-party claims.

7.5 Firearms- and Hunting Clause
I confirm that I will comply with all applicable firearm laws and will only handle firearms under the supervision of authorised personnel. I acknowledge the inherent dangers associated with firearms.

7.6 Medical Fitness and Emergency Consent
I confirm that I am medically fit to participate. In the event of an emergency, I authorise the operator to obtain medical treatment on my behalf at my own expense.

7.7 Compliance
I agree to follow all instructions. Failure to comply may result in removal without refund.

7.8 Data Protection (POPIA)
I consent to the collection and processing of my personal information in accordance with the Protection of Personal Information Act (POPIA) for operational, safety, and legal purposes.

8. Passport, Visa, and Health Regulations

The Customer is responsible for complying with all regulations important for the trip (passport validity, visas, firearm import licenses, vaccinations, customs regulations). Any disadvantages resulting from non-compliance with these regulations shall be borne by the Customer.
